Note(s)On the 13th May 2013 the Department of the Environment, Community and Local Government issued a new policy directive to all planning authorities outlining three main objectives intended to reform and produce a more effective planning enforcement system. The article looks at reasons for low conviction rates for planning cases prosecuted in the courts. It asks the question whether those in breach of planning legislation should be considered to be criminally liable?
